Any dispute arising out of or in connection with this agreement, including any question regarding its existence, amendment, validity or termination, shall be referred to & finally resolved by arbitration in accordance with the Indian Arbitration & Conciliation Act, 1996. The arbitration shall be a “documents only”, evidence through affidavits “fast track” arbitration. The exclusive seats of arbitration shall be Bengaluru, India & the language of the arbitration shall be English.
This agreement shall be governed by & construed in accordance with the laws of India.

In respect of all matters/disputes arising out of, in connection with or in relation to this agreement, only the civil courts at Bengaluru City, India shall have jurisdiction, to the exclusion of all other courts.

The MERCHANT reserves the right to change the prices at any time.Your payment will normally reach the MERCHANT account to which you are making a payment within two working days.The MERCHANT cannot accept liability for a payment not reaching the MERCHANT account due to you quoting an incorrect account number or incorrect personal details or for any other fault. The Merchant shall not accept liability if payment is refused or declined by the netbanking system / credit/debit card supplier for any reason.If the card supplier declines payment the MERCHANT is under no obligation to bring this fact to your notice. You should check with your bank/credit/debit card supplier that payment has been deducted from your account and reached the MERCHANT.In no event , the MERCHANT shall be liable for any loss, damages, compensation whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
RefundsRefunds, if applicable, at the discretion of the MERCHANT and shall be made only to the netbanking account/debit/credit card used for the original transaction. For the avoidance of doubt nothing in this Policy shall require the MERCHANT to refund the Fees (or part thereof) unless such Fees (or part thereof) have previously been credited to the MERCHANT account.
Any matter, dispute, resolution on the presents are subject to the exclusive jurisdiction of Bengaluru Court only.

Terms & Conditions
1.1. Briefcase provides a subscription that allows our subscribers to access content (“Briefcase content”) over the Internet to certain mobile phones, computers and other devices (“Briefcase ready devices”). By subscribing to the Briefcase, you deem to accept the Terms & Conditions.
1.3. Your Briefcase subscription will continue by itself until terminated. To use the Briefcase service you must have Internet access and a Briefcase ready device, and provide a current, valid, accepted method of payment, which you may update from time to time (“Payment Method”). Unless you cancel your subscription before your billing date, you authorize us to charge your next month’s subscription fee to your Payment Method (see “Cancellation” below).
2.1. Your Briefcase subscription may start with a free trial. The free trial period of your subscription lasts for one month, or as otherwise specified during sign-up and is intended to allow new subscribers and certain former subscribers to try the service.
2.2. Free trial eligibility is determined by Briefcase at its sole discretion and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible at our discretion without assigning any reason. We may use information such as device ID, method of payment or an account email address used with an existing or recent Briefcase subscription to determine eligibility.
2.3. We will charge your Payment Method for your monthly subscription fee at the end of the free trial period unless you cancel your subscription prior to the end of the free trial period. To view the monthly subscription price and end date of your free trial period, visit our website and click the “Billing details” link on the “Your Account” page.
3.1. Billing Cycle. The subscription fee for the Briefcase service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your Payment Method on the calendar day corresponding to the commencement of the paying portion of your subscription. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your paid subscription began on a day not contained in a given month.
3.2. Payment Methods. You cannot change your Payment Method during the tenure of your Subscription. If your selected Payment Method is no longer available or expires or your Payment Method fails for whatsoever reason, you will be responsible and liable for payment of any uncollected amounts and/or we reserves the right to terminate the Subscription offered. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
3.3. Cancellation. You can cancel your Briefcase subscription at any time, and you will continue to have access to the Briefcase service through the end of your monthly billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial-month subscription periods or unwatched Briefcase content. To cancel, go to the “Cancel Subscription” page and follow the instructions for cancellation. If you cancel your subscription, your account will automatically close at the end of your current billing period. If you signed up for Briefcase using your account with a third party as a Payment Method and wish to cancel your Briefcase subscription, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Briefcase service through that third party. You may also find billing information about your Briefcase subscription by visiting your account with the applicable third party.
3.4. Changes to the Price and Service Plans. We may change our service plans and the price of our service from time to time; however, any price changes or changes to our service plans will apply to you no earlier than 30 days following such change.

You agree to immediately notify Karnataka News Publications Private Limited if you become aware of the loss, theft or unauthorised use of any password, user ID or e-mail address or of any Sanjevani Content. You will provide Karnataka News Publications Private Limited with accurate, complete registration information and inform Karnataka News Publications Private Limited of any changes to such information. • KNPL provides a subscription that allows our subscribers to access content (“Sanjevani Content”) over the Internet to certain mobile phones, computers and other devices. By subscribing to the KNPL, you deem to accept the Terms & Conditions.
• Our KNPL subscription may start with a free trial. The free trial period of your subscription specified during sign-up is intended to allow subscribers to try the service.
• Free trial eligibility is determined by KNPL at its sole discretion and we may limit eligibility to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold in the event that we determine that you are not eligible at our discretion without assigning any reason. We may use information such as device ID, method of payment or an account email address used with an existing or recent KNPL subscription to determine eligibility.
Unless specifically stated in any Subscription offer or promotion when you place your Subscription order with Karnataka News Publications Private Limited. Karnataka News Publications Private Limited will contact you at the end of the initial subscription period with an offer to renew your subscription at the then prevailing renewal rate, which may be changed from time to time.
To cancel your subscription, please write to email@example.com. No refund is applicable after 7 days from the day of purchasing the product.
Contract and Disputes
Karnataka News Publications Private Limited shall provide your Subscription in accordance with these Terms (and the terms of any offer or promotion that may apply to your Subscription). Fees and Payments
You are responsible for any fees that are payable including any processing or other fees charged by the issuing bank/payment provider.
The price to be paid for your Subscription will be made clear to you on the Subscription order pages or otherwise during the order process and may vary from time to time. You agree to pay the fees at the rates notified to you at the time you purchase your Subscription together with any processing or other associated fees charged by the issuing bank/payment provider. Eligibility for any discounts if applicable is ascertained at the time you subscribe and cannot be changed during the term of your Subscription. All payments from outside India (including any applicable taxes) must be made in US Dollars. If we find out that you are from outside India and are transacting in INR, your account will be suspended You are responsible for the payment of all charges associated with the use, by you or someone else, of the Site using your ID. When you purchase a Subscription or access to any other Content owned by Sanjevani, you must provide Karnataka News Publications Private Limited with complete and accurate payment information. By submitting payment details you confirm that you are entitled to use those payment details for this purpose. If Karnataka News Publications Private Limited do not receive payment authorisation or any authorisation is subsequently cancelled, Karnataka News Publications Private Limited may immediately terminate or suspend your access to your Subscription or Sanjevani Content and in suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities.

Changes to the Site
Karnataka News Publications Private Limited reserves the right, in its discretion and at any time, to suspend, change, modify, add or remove portions of Sanjevani Content available on the Site at any time and to restrict the use and accessibility of the Site.

Karnataka News Publications Private Limited will not be held responsible for circumstances beyond its control.
Karnataka News Publications Private Limited, its affiliates and its information providers will not be liable or deemed to be in default for any delay or failure in performance or interruption of the delivery of Karnataka News Publications Private Limited Content that may result directly or indirectly from any cause or circumstance beyond its or their reasonable control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorised access, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labour problems, wars, or governmental restrictions.

Changes to these Terms. Karnataka News Publications Private Limited may, in its discretion, change these Terms (including those that relate to your use of the Site. Rather, the Terms will then be read and construed as if the invalid or unenforceable provision(s) are not contained therein. If you are outside of the United States, any cause of action of yours with respect to these Terms must be filed in a court of competent jurisdiction in London, England, within one year after the cause of action has arisen, or such cause will be barred, invalid and void. If you are in the United States, any cause of action of yours with respect to these Terms must be filed in arbitration within one year after the cause of action has arisen, or such cause will be barred, invalid and void.
Whole Agreement. Save as expressly referred to herein, any representation, warranty, term or condition not expressly set out in these Terms shall not apply.
Headings. Headings in these Terms are for convenience only and have no legal meaning or effect, nor shall they be taken into account in interpreting these Terms.
Term and Termination
THG Publishing Private Limited may at its discretion terminate or suspend your access to The Hindu Content at any time without notice to you all or part of the Site with or without cause by delivering notice to you.
No Class or Representative Proceedings; Class Action Waiver. YOU AND KARNATAKA NEWS PUBLICATIONS PRIVATE LIMITED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Karnataka News Publications Private Limited agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.
